⚡ Summary: Pinch HR is a SaaS HR platform. You use it to manage your employees. You own your data. We provide the infrastructure. Please don't misuse the platform. If you're a paying subscriber, the billing terms apply. Kenyan law governs this agreement.
01Acceptance of Terms
By registering an account, accessing the Pinch HR platform at hr.pinch.co.ke or any related subdomain, or using any of our APIs or services, you ("Agency Admin", "User", or "Subscriber") agree to these Terms and Conditions in full. If you disagree with any part, you may not access the Service.
- These Terms apply to all users including agency administrators, managers, directors, and employees.
- We reserve the right to update these terms at any time with 14 days' notice via the platform or registered email.
- Continued use of the platform after changes constitutes acceptance of revised terms.
02The Platform
Pinch HR provides a multi-tenant Software-as-a-Service (SaaS) platform for human resources management. Features include, but are not limited to:
- Employee leave management and balance tracking
- Performance review cycles and analytics
- Secure document vaults with permission-based access
- AI-assisted HR concierge (Gemini-powered)
- Team communications and announcements
- Employee onboarding workflow management
- Director-level analytics and reporting
We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice. We will not be liable for any modification or suspension of the Service.
03Accounts & Workspaces
Each organisation registered on Pinch HR is assigned an isolated workspace ("Agency"). Agency Admins are responsible for all activity that occurs within their workspace.
- You must provide accurate and complete registration information.
- You must maintain the confidentiality of your account credentials.
- The same email address may be registered in multiple agencies without conflict.
- Agency Admins are responsible for properly offboarding employees when they leave the organisation.
- You must notify us immediately of any unauthorised access.
04Data & Privacy
You retain full ownership of all data you upload to the platform. By using Pinch HR, you grant us a limited, non-exclusive licence to store, process, and display your data solely to provide the Service.
- We do not sell your data to third parties.
- Data is stored on servers located in Kenya and/or the European Union.
- You may export or delete your data at any time.
- Employee personal data must be handled in accordance with Kenya's Data Protection Act, 2019.

05Intellectual Property
The Pinch HR platform, including its design, software, branding, and content, is the intellectual property of Pinch Africa. All rights are reserved.
- You may not copy, reproduce, or distribute any part of the platform without written permission.
- Any feedback or suggestions you provide may be used by us to improve the platform without compensation.
- Your organisation's logo, data, and custom content remain your property.
06Billing & Subscriptions
Access to certain features requires a paid subscription plan. All billing is processed securely via Intasend.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- Prices are displayed in Kenyan Shillings (KES) and may be subject to applicable taxes.
- Refunds are not available except where required by Kenyan consumer protection law.
- Downgrading your plan may result in loss of access to features associated with higher tiers.
- We reserve the right to suspend accounts with overdue payments after a 7-day grace period.
💳 All plans include a 14-day free trial. No credit card required to start. You will only be billed after the trial period and only if you choose to subscribe.
07Acceptable Use
You agree not to use Pinch HR for any unlawful or prohibited purpose. Prohibited activities include:
- Uploading malicious code, viruses, or any disruptive material
- Attempting to gain unauthorised access to other agencies' data
- Using the platform to harass, discriminate, or harm employees
- Reverse-engineering or attempting to extract the source code
- Exceeding plan limits or sharing access credentials
- Using the AI assistant to generate harmful, illegal, or misleading content
Violation of acceptable use may result in immediate suspension without refund.
08Termination
Either party may terminate the agreement at any time. You may cancel your subscription via the platform settings. We may terminate your account for:
- Violation of these Terms or our Acceptable Use Policy
- Non-payment beyond the grace period
- Requests that our systems are being used for fraudulent activity
Upon termination, your data will be retained for 30 days before permanent deletion, giving you time to export it.
09Limitation of Liability
To the fullest extent permitted by law, Pinch Africa shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid in subscription fees in the 3 months preceding the claim.
The platform is provided "as is" without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free.
10Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
